On measures to implement the Decree of the President
Republic of Belarus dated August 7, 2019 № 300
On the basis of part two of paragraph 4 of the Decree of the President of the Republic of Belarus dated August 7, 2019 № 300 «On the establishment of a visa-free procedure for the entry and exit of foreign citizens», the Council of Ministers of the Republic of Belarus DECIDES:
1. Approve the Regulations on the procedure for citizens to visit the visa-free territory «Brest-Grodno», as well as the territories of the districts of the Brest and Grodno regions that are not part of this territory (attached).
2. Install:
form of a document granting citizens the right to individual
visiting the visa-free territory «Brest - Grodno», according to Appendix 1;
a form of a document granting citizens the right to group visits to the visa-free territory «Brest - Grodno», as well as the territories of the districts of the Brest and Grodno regions that are not part of this territory, in accordance with Appendix 2.
3. Recognize as invalid the Resolution of the Council of Ministers of the Republic of Belarus dated December 28, 2017 № 1017 «On measures to implement the Decree of the President of the Republic of Belarus dated December 26, 2017 № 462».
4. This resolution comes into force on November 10, 2019

POSITION
on the procedure for citizens to visit the visa-free territory «Brest-Grodno»,
as well as the territories of the districts of the Brest and Grodno regions,
not part of the territory
1. This Regulation determines the procedure for visiting by citizens of the states specified in Annex 1 to the Decree of the President of the Republic of Belarus dated August 7, 2019 № 300 (hereinafter referred to as citizens), for tourism purposes for up to fifteen days, the following territories where a visa-free entry procedure is in force and departure (hereinafter, unless otherwise indicated, visa-free territories):
visa-free territory «Brest - Grodno» - when citizens visit this territory individually;
visa-free territory «Brest - Grodno», as well as the territories of the districts of the Brest and Grodno regions that are not part of this territory - when visiting these territories in a group while following the itinerary of a tourist trip.
2. Entry of citizens into the Republic of Belarus to visit visa-free territories, departure of citizens from the Republic of Belarus are carried out at checkpoints across the State Border of the Republic of Belarus, specified in Annex 2 to the Decree of the President of the Republic of Belarus dated August 7, 2019 № 300.
3. The period of stay of citizens during visa-free entry into the Republic of Belarus and exit from the Republic of Belarus at the checkpoints across the State Border of the Republic of Belarus, defined in Appendix 2 to the Decree of the President of the Republic of Belarus dated August 7, 2019 № 300, is the duration of the tour, implemented by the subject of the tourist activities providing services in the visa-free territory (hereinafter referred to as the subject of tourism activity).
When citizens purchase additional tourist services*, the period of stay, at the request of citizens, is extended by the subjects of tourism activities. In this case, the subject of tourism activity sends a corresponding notification to the Ministry of Sports and Tourism or its authorized body (hereinafter referred to as the authorized body) in the manner prescribed in part four of paragraph 10 of these Regulations.
The duration of the tour, including when it is extended, must not exceed the period specified in paragraph 1 of these Regulations.
* For the purposes of this Regulation, additional tourist services are understood as tourist services, the purchase of which within the framework of a tour implemented by a tourist activity entity entails an increase in the period of stay of citizens (additional excursions, transfer services, medical and other services with the mandatory inclusion of additional accommodation in a hotel or similar facility accommodation, as well as accommodation in an agro-eco-estate).
4. The territories that make up the visa-free territory «Brest - Grodno» are determined by Decree of the President of the Republic of Belarus dated August 7, 2019 № 300.
5. Citizens arrive in the visa-free territory on the basis of:
a valid passport or other document replacing it, intended for traveling abroad and issued by the relevant authority of the state of nationality or an international organization (hereinafter referred to as the document for traveling abroad);
a document granting citizens the right to visit the visa-free territory, in the form established in accordance with Appendix 1 or 2 to the resolution approving these Regulations (hereinafter referred to as the document for the right to visit), provided that information about such a document is available in the automated border control system of the border service.
The document on the right to visit grants citizens the right to a single entry into the Republic of Belarus and exit from the Republic of Belarus.
6. In the interests of citizens who intend to order, order or ordered tourist services, the provision of which allows them to make a tourist trip in a visa-free territory, documents for the right to visit may be filled out in a foreign language.
The text of documents for the right to visit in a foreign language must correspond to the text of such documents in Russian or Belarusian.
7. No fee is charged for filling out and (or) issuing documents for the right to visit.
8. Citizens submit the following information to the subjects of tourism activities in electronic or written form:
surname, first name, patronymic (if any);
day, month, year of birth;
citizenship (citizenship);
series, document number for traveling abroad;
gender;
contact details (e-mail address, mobile phone number);
the date of the proposed entry to visit the visa-free territory, corresponding to the date of the start of the tourist trip in accordance with the concluded agreement, on the basis of which the tour is being implemented.
Information in the document for the right to visit is entered by the subject of tourism activity in Latin transcription in accordance with the machine readable zone of the document for traveling abroad.
The document for the right to visit is issued by the subject of tourism activity with the subsequent transfer of the relevant information in electronic form to the authorized body no later than 72 hours before the expected time of entry into the territory of the Republic of Belarus.
Simultaneously with the information provided for in part three of this paragraph, the subject of tourism activity sends to the authorized body information about himself, the date and number of the contract on the basis of which the tour is being implemented, about the travel services provided, indicating the address of the location of the accommodation facilities and the number of nights the citizens live in them , the cost of tourist services, the method and time of their payment.
The authorized body confirms the receipt from the subject of tourism activities of the information provided for in parts three and four of this paragraph, no later than 24 hours from the moment of their receipt.
The authorized body ensures the transfer to the State Border Committee and internal affairs bodies in electronic form via technical communication channels or on an external medium of information about citizens who have documents for the right to visit, no later than 24 hours before the expected time of entry into the territory of the Republic of Belarus. The format for presenting such information is determined within the framework of a joint agreement between the authorized body, the border service bodies and the internal affairs bodies.
If the actual entry into the territory of the Republic of Belarus is not made before the end date of the tourist trip in accordance with the concluded agreement on the basis of which the tour is being implemented, the document for the right to visit is cancelled.
9. A visit by citizens of a visa-free territory is organized by the subjects of tourism activities that have a certificate of conformity of tourism services, obtained in the manner of voluntary confirmation of conformity.
10. When planning the entry of citizens into the Republic of Belarus, the departure of citizens from the Republic of Belarus as part of tourist groups, subjects of tourism activities that meet the requirements of paragraph 9 of these Regulations are required to reflect in the tourist travel program the following information:
on the date and number of the concluded contract, on the basis of which the tour is being implemented, the cost of tourist services, the method and time of their payment, the route of the tourist trip, the date and time of its start and end;
about the expected brands and state numbers of vehicles transporting citizens as part of a tourist group;
on the tourist services provided, indicating the address of the location of the accommodation facilities and the number of nights the citizens stay in them;
about the places of entry into the Republic of Belarus and exit from the Republic of Belarus.
The itinerary of a tourist trip within the territory of the Republic of Belarus must begin and end at checkpoints located on the visa-free territory «Brest - Grodno».
The subject of tourism activity has the right to change the route of tourist travel of citizens as part of a tourist group within the visa-free territory due to unforeseen circumstances or security requirements.
When changing the route of a tourist trip due to unforeseen circumstances or security requirements, the subject of tourism activity makes changes to the document for the right to visit, and immediately informs the authorized body about such changes.
Upon receipt of information about a change in the route of a tourist trip due to unforeseen circumstances or security requirements, the authorized body no later than 24 hours from the receipt of such information ensures its transmission in electronic form to the State Border Committee and internal affairs bodies.
11. When providing tourist services to citizens as part of tourist groups, the head of the tourist group, who is a representative of the subject of tourism activity, must be included in its composition.
12. The costs associated with the deportation or expulsion of citizens are paid at the expense of citizens or subjects of tourism activities that issued a document for the right to visit, in the manner prescribed by law.
13. Citizens who are in a visa-free territory and have lost their document for the right to visit, apply to the subject of tourism activities that provided tourism services to obtain a duplicate of such a document.
14. Citizens who are in the visa-free territory and have lost their document for traveling abroad, apply to the nearest internal affairs body located in the visa-free territory.
15. Prior to the issuance by a diplomatic mission or a consular office of the state of nationality of a citizen of a document for leaving the Republic of Belarus, based on the results of an inspection by the internal affairs body, a certificate is issued confirming the identity of a foreign citizen or stateless person, in the form approved by the Resolution of the Council of Ministers of the Republic of Belarus dated June 10, 2010 № 892.
16. Citizens entering the Republic of Belarus on the basis of a document for the right to visit are required to stay only in the visa-free territory.
17. Entry (entrance) to the border strip and the border zone of the visa-free territory «Brest - Grodno», temporary stay and movement in this territory of citizens who have the documents specified in part one of paragraph 5 of this Regulation, is carried out within the highways marked tourist routes (bicycle, pedestrian, water and others), agreed with the territorial bodies of the border service.
18. Citizens who visited the visa-free territory are required to leave the Republic of Belarus before the expiration of the period of stay on the implemented tour.
19. In the event of natural disasters, accidents or emergencies of a natural or man-made nature, illness or health condition, occurrence of other unforeseen circumstances that prevent a citizen from leaving the Republic of Belarus before the expiration of the period of stay specified in paragraph 1 of this Regulation, the citizen or his representative shall apply to the nearest internal affairs body with an application for an extension of the period of temporary stay and registration.
When extending the period of temporary stay, the internal affairs body issues a visa to a citizen to leave the Republic of Belarus, unless otherwise specified by international treaties of the Republic of Belarus.
In the cases specified in this paragraph, the departure of citizens is carried out at any international checkpoint across the State Border of the Republic of Belarus.
20. Control over the stay in the Republic of Belarus of citizens who entered on the basis of a document for the right to visit is carried out by the internal affairs bodies, the border service and state security.
When establishing citizens who have left the visa-free territory or evaded the route of a tourist trip, with the exception of cases provided for in part three of paragraph 10 of these Regulations, from leaving the Republic of Belarus within the prescribed period, the internal affairs bodies, the border service, state security in accordance with their competence considers the issue of bringing to administrative responsibility for violation of the legislation on the legal status of foreign citizens and stateless persons in the Republic of Belarus.
The subjects of tourism activities are obliged to inform the nearest internal affairs body about citizens who have evaded the route of a tourist trip and do not get in touch for more than one day.
